Nancy Baughan and Trish Treadwell recently obtained a favorable ruling from the Eleventh Circuit Court of Appeals, affirming an order from the Northern District of Georgia granting summary judgment to two of the Firm’s bank clients. Following extensive briefing at the lower and appellate courts (with assistance from Erin Moore), Nancy Baughan successfully argued the issues on appeal before a three-judge panel of the Eleventh Circuit. The outcome affirms the banks’ right to rely on their deposit agreements to delegate certain duties and responsibilities to customers, thereby relieving the banks of certain liabilities.
