The commercial finance team, led by Bobbi Acord Noland, Jonathan Bush and Jason Loring, recently represented a U.S. banking institution in the structuring, negotiation and closing of a stand-alone revolving credit facility to a Hong Kong affiliate of an existing U.S. borrower, which credit facility also included credit support in the form of a Dutch guaranty and equity pledge. The transaction involved a number of jurisdictional complexities and legal requirements under Hong Kong and Dutch law, and was brought to a successful closing with the assistance of Gallant Y.T. Ho & Co. and Lexence N.V., the firm’s Hong Kong and Dutch Meritas affiliates, respectively.
