Josh Lewis and Eric Anderson were successful in obtaining dismissal of a suit brought in the U.S. District Court for ND Georgia, against RA, Inc. by Amegy Bank. Amegy sued to attempt to impose an equitable lien and for other equitable remedies against real estate that our client had purchased out of a bankruptcy of the previous owner. Amegy's claims were based upon alleged wrongdoing by the principal of the prior owner, who was a borrower on unrelated loans from Amegy. Judge Owen Forrester rejected all of Amegy's contentions and dismissed its amended complaint with prejudice, representing a complete victory for the client.
