In a combined effort by the firm's litigation and bankruptcy practice groups, the firm won an affirmance in the Eleventh Circuit Court of Appeals of lower court wins for our client in Crumpton v. McGarrity, No. 12-15604(11th Cir. April 16 2013). In the case, the plaintiff, a bankruptcy trustee, had sued our client to recover tax draws he had received as a shareholder in a company which subsequently filed bankruptcy. The trustee claimed the draws constituted fraudulent conveyances. The Eleventh Circuit agreed with our arguments and the U.S. District Court and the Bankruptcy Court that the transfers to our client were for “reasonably equivalent value” by virtue of the company’s Subchapter S election.
