Ron Coleman, Jared Miller, and Megan Hinkle recently obtained a complete defense verdict in a six-day jury trial of a medical malpractice claim brought against the firm's clients Quest Diagnostics Incorporated and Quick-Med, Inc., in which the plaintiff sought at least $7 million at trial. Previously, a jury in the Fulton County State Court had awarded nearly $5.5 million against Quest and Quick-Med on this same claim and related claims. PHRD was retained initially to handle post-trial motions and secured a new trial on the issue of damages. The State Court then subsequently granted PHRD's motion for sanctions for fraud on the Court, based on evidence developed by PHRD, and vacated the prior jury's verdict in its entirety, including with respect to liability. The plaintiff subsequently dismissed his claim and re-filed it in the Fulton County Superior Court. Following additional discovery, PHRD recently served as lead trial counsel for the clients in a re-trial of the plaintiff's claim. Following a six-day jury trial, the jury returned a complete defense verdict in favor of the firm's clients.
