Armando Basarrate, David Darden, and Elizabeth Murphy recently secured a victory for a major healthcare system client by obtaining a final agency decision granting the hospital Certificate of Need approval to establish radiation therapy services on one of its hospital campuses. The Department of Community Health initially approved the project. Several area providers challenged the Department's initial decision, arguing that the Department’s approval of the project was inconsistent with applicable review criteria and prior agency decisions. Following an administrative evidentiary appeal hearing, a Certificate of Need Appeal Panel Hearing Officer rejected the opponents’ arguments and issued an order affirming the Department's initial decision. The opponents then appealed to the Commissioner of the Department of Community Health. The Commissioner rejected the opponents’ arguments and issued a final agency decision awarding Certificate of Need approval for the client’s project.
