Bill Holley, Scott Zweigel, and Peter Busscher recently obtained a complete dismissal of a putative class action filed against an important bank client related to alleged misrepresentations regarding Vendor's Single Interest ("VSI") insurance for automobile loans. Granting an early motion to dismiss, Judge Richard Story (Northern District of Georgia) ruled that many of the common disclosures made by lenders in connection with VSI insurance were not fraudulent as a matter of law. The case is Page v. Branch Banking and Trust Co., No. 2:14–CV–00055–RWS, 2015 WL 751675, 2015 U.S. Dist. LEXIS 21021 (N.D. Ga. Feb. 23, 2015).
